This Participant Terms & Service ("Terms") applies to your registration and participation in events through the Heyrace platform ("Platform") operated by Triple Wave Pte. Ltd. ("we", "us", or "our"), a company incorporated in Singapore (UEN 202030758R). By creating an account or registering for an event on our Platform, you ("Participant" or "you") agree to be bound by these Terms and any additional event-specific rules or terms provided by the event organiser ("Organiser"). If you do not agree, please do not use the Platform or register for events.
These Terms outline the conditions for event registration, submission of results, participation in virtual and physical races, and limit our liabilities. Organisers are independent third parties who host events on the Platform, and each Organiser may impose additional rules or requirements for their events.
1. Event Registration and Accounts
- Account Creation: To register for an event, you may be required to create a personal account on the Platform. You must provide accurate and complete information (such as your name, contact information, and age) during registration. You are responsible for maintaining the confidentiality of your account login and for all activities under your account.
- Eligibility: You must be at least 18 years old to register for an event. If you are under 18, a parent or legal guardian must register on your behalf and consent to these Terms. By registering, you represent that you are medically fit to participate in the event and have no condition that would make your participation unsafe.
- Event Organiser Terms: Each event may have its own rules, waiver, or terms set by the Organiser (for example, specific race rules, age or category restrictions, safety requirements, etc.). You agree to review and comply with the event-specific terms in addition to these Platform Terms. In case of a conflict between these Terms and an Organiser's terms, these Terms will govern your relationship with us, while the Organiser's terms govern your participation in that specific event.
- Registration Confirmation: Your registration for an event is confirmed only after successful payment of the registration fee and issuance of a confirmation (such as a booking ID or confirmation email). We reserve the right to refuse or cancel a registration (with a refund of any payment) if eligibility criteria are not met or if there was an error in pricing or event information.
- Non-Transferable: Registrations are generally non-transferable to other persons or events, unless the Organiser explicitly allows transfer according to their policies. You agree not to sell or transfer your race entry without permission. Organisers and the Platform reserve the right to cancel any registration that has been transferred or sold in violation of this clause without refund.
2. Fees, Payments and Refund Policy
- Payment Processing: All registration fees are quoted in the currency stated on the event page (typically Singapore Dollars, "SGD", unless otherwise specified). Payments are processed via our third-party payment gateway or service providers. By registering, you authorize us or our payment processors to charge your provided payment method for the total amount of the registration fee and any additional fees (e.g., processing charges or delivery fees, if applicable).
- Third-Party Payment Providers: We use reputable payment processing services to handle your payment information. We do not store your full credit/debit card details on our servers. All transactions are encrypted and subject to the terms and privacy policies of the payment provider. We are not liable for any payment processing errors or security breaches arising from the payment provider, though we will reasonably assist in rectifying issues.
- Registration Fees and Taxes: Registration fees may include charges for participation, administration, and any goods or services expressly stated (such as race kits or merchandise). Any applicable taxes (e.g., GST in Singapore) are included in the price unless stated otherwise. You are responsible for any bank fees or currency exchange differences if you are using an international payment method.
- All Sales Final: Unless otherwise stated in the event's specific policy or required by law, all registrations are final and non-refundable. Once you have registered and paid for an event, you will not be entitled to a refund if you decide not to participate or cannot attend, except as allowed under the event's cancellation policy or these Terms.
- Event Cancellations and Changes: If an event is cancelled or significantly changed by the Organiser (e.g., change of date, conversion from physical to virtual format, etc.), the Organiser's refund or transfer policy will apply. The Platform will facilitate any refunds or credits authorized by the Organiser. Typically:
- If an event is cancelled by the Organiser and not rescheduled, you may be entitled to a refund of the registration fee (excluding any transaction fees that are non-refundable) unless the Organiser's policy states otherwise (for example, some events may offer credit for a future event instead).
- If an event is postponed or rescheduled, your registration will usually be honored for the new date. If you cannot attend the new date, you must follow the Organiser's policy for withdrawals or refunds (a refund may not be guaranteed unless the Organiser offers it).
- If an in-person event is converted to a virtual event (or vice versa), the Organiser will notify you of the change and any options (such as remaining in the virtual event, transferring to a different event, or requesting a refund if offered).
- Platform Fee: We do not charge Participants a separate fee for using the Platform beyond the registration fee, unless expressly stated (for instance, optional add-ons you choose to purchase). Any service fees or processing fees will be shown at checkout before you pay. The Organiser may be responsible for fees payable to the Platform; such arrangements do not typically affect the amount you pay as a participant.
- Refund Process: In cases where a refund is approved (due to event cancellation or other reasons per Organiser's policy), the refund will be processed via the original payment method wherever possible. Please note that it may take several business days for the refunded amount to appear in your account, depending on your bank or card provider. Transaction fees and payment processing fees may not be refundable (as those might have been incurred to process the initial payment).
- Chargebacks: You agree to contact us or the Organiser to resolve any payment disputes before initiating a chargeback with your card issuer. Unwarranted chargebacks after a service has been provided may be considered fraudulent. We reserve the right to suspend your account for excessive or improper chargeback activity.
3. Virtual Race Participation and Result Submission
For virtual events (races that you complete at your chosen location and time within a stated period), you are responsible for recording and submitting your results as per the event requirements:
- Methods of Submission: Results can be submitted either (a) manually through the Platform (by entering your time and distance and uploading required evidence, such as a screenshot or photo of your running app or watch), or (b) by syncing with a supported fitness tracking service like Strava. The event page will specify the allowed submission methods.
- Strava Integration: If you choose to connect your Strava account or another third-party fitness account to submit results, you must authorize the Platform to access your activity data. By doing so, you grant us read-only access to relevant information (such as activity date, distance, duration, and GPS tracks) needed to verify your race completion. We will only use this data to validate your result for the event. Your use of Strava or any third-party service is subject to that service's own terms and privacy policy, and we are not responsible for their services. It is your responsibility to ensure your activity is recorded properly on Strava (for example, that your GPS signal was adequate and the activity is not marked as private) before the submission deadline.
- Accuracy of Results: Whether submitting manually or via Strava, you must ensure that the results and evidence you provide are accurate, truthful, and reflect your own completion of the race. Submitting results for an activity you did not personally complete, falsifying times or distances, or manipulating data (for example, using an electric bicycle or vehicle in a running event, or altering GPS data) is strictly prohibited.
- Verification: All submitted results are subject to review and verification by the Organiser (and/or by us, on behalf of the Organiser). The Organiser reserves the right to request additional evidence or clarification regarding your result. For manual submissions, you may be required to provide a screenshot from a tracking app or a photo of your treadmill display, etc., as proof. Failure to provide satisfactory proof of completion upon request may result in your result being rejected.
- Submission Deadline: Each virtual event will have a deadline by which results must be submitted (e.g., within a certain number of days after the race period ends). It is your responsibility to submit your results before the deadline. Late submissions may not be accepted or may be marked as unofficial, at the Organiser's discretion.
- Cheating and Fair Play: We and the Organisers are committed to fair play. Activities and results may be audited for signs of cheating. If you are found or suspected, in the Organiser's reasonable opinion, to have cheated or violated the event rules (for example, by having someone else run for you, completing the distance by riding a bicycle or vehicle, or cutting a route short), the Organiser has the right to disqualify you from the event. Disqualification may include removal from the results, ineligibility for any finisher entitlements (such as medals or certificates), and potential bans from future events on the Platform.
- No Guaranteed Accuracy: GPS-based tracking and fitness apps are not 100% accurate. Small discrepancies in recorded distance or time will generally be accepted if within reasonable tolerance as determined by the Organiser. However, it is your responsibility to ensure you complete at least the required distance for the event. Neither the Platform nor the Organiser is responsible for errors in your tracking device or app (such as losing GPS signal or a device malfunction). If technical issues prevent you from using Strava or the Platform's submission tools, you should contact the Organiser promptly to seek an alternative method to submit your result.
- Personal Conduct: While participating in a virtual race, you agree to do so safely and responsibly. This means choosing a safe environment and route (for outdoor runs, obeying traffic laws and pedestrian safety rules, etc.), not endangering yourself or others, and respecting any local health guidelines (such as social distancing, if applicable). You are solely responsible for your safety and decision to participate under the conditions you choose.
4. Physical Event Participation
For physical (in-person) events, the following additional terms apply:
- Assumption of Risks: By registering for a physical race event, you acknowledge that running or participating in endurance events carries inherent risks, including but not limited to serious injury, illness (such as heatstroke or dehydration), and even death. You voluntarily assume all risks associated with your participation. It is your responsibility to train adequately and ensure you are in appropriate physical condition before participating. If you have any health conditions or concerns, you should consult a medical professional before participating.
- Event Day Procedures: You agree to follow all instructions and rules provided by the Organiser and race officials on the event day. This includes safety protocols, route instructions, start times, cutoff times, and any health and safety measures (for example, COVID-19 related guidelines if applicable). Failure to adhere to official instructions may result in removal from the event without entitlement to any refund.
- Race Bibs and Identification: You may be issued a race bib (or electronic timing device) which is personal to you. You must wear any required bib or device as instructed during the event. You may be required to show government-issued photo identification (e.g., ID card or passport) when collecting your race kit or bib to verify your identity. Collecting race materials for another person may require presenting their ID copy and an authorization letter, subject to the Organiser's specific pick-up policy.
- Race Pack Collection: If the event provides a race pack (e.g., bib, shirt, goodies) to participants prior to the race, you must collect it at the designated location and time(s) specified by the Organiser. Race packs are typically not mailed out before the event unless explicitly offered. If you are unable to collect your pack in person, check if the Organiser allows someone else to collect on your behalf (usually with written authorization and copies of IDs). Any race packs not collected as per the event instructions may be forfeited, unless the Organiser provides an alternative arrangement at their discretion.
- Medical Attention: You consent to any medical attention (first aid, emergency care, etc.) that may be deemed necessary by event medical staff during your participation. You agree that you are responsible for any medical costs incurred if not covered by the Organiser. It is recommended that you have personal health insurance coverage for events of this nature.
- Removal from Event: The Organiser or race officials reserve the right to remove you from the course or disqualify you if, in their judgment, you are unable to continue safely, are endangering yourself or others, or have violated event rules or these Terms. If you are removed or disqualified for cause (e.g., rule violation or safety reasons), you will not be entitled to a refund.
5. Finisher Entitlements and Certificates
- Finisher Entitlements: Depending on the event, participants who complete the race in accordance with the rules may receive finisher entitlements such as medals, t-shirts, or other memorabilia. These items are usually described on the event page. Entitlements are subject to availability and are provided by the Organiser. The Platform is not responsible for any failure by the Organiser to deliver advertised entitlements, but we may assist in facilitating communication if issues arise.
- e-Certificates: Many events (especially virtual races) provide digital finisher certificates to participants who successfully complete the event. If you meet the event's completion criteria (for example, finishing within a certain time or by the deadline and submitting your result properly), you will be able to download or receive an electronic certificate through the Platform or via email. Certificates typically include your name, event name, distance, and finish time.
- Eligibility for Certificate: You will only receive a finisher certificate if you have complied with all event requirements. Participants disqualified for any reason (cheating, rule violations, or other non-compliance) will not receive a certificate. The Organiser has the right to withhold or revoke a certificate if an error is discovered or if a participant's result is invalidated after initial issuance.
- Accuracy of Information: If you believe there is an error on your certificate (such as a misspelled name or incorrect time), you should contact the Organiser promptly to request a correction. Minor errors can typically be corrected, but final decisions on results and certificates rest with the Organiser.
- No Monetary Value: Finisher medals, shirts, certificates, and similar entitlements have no cash value and cannot be exchanged for cash or refunds. If you are entitled to such items but do not claim or receive them (for example, failing to download a certificate within a certain time or not collecting a medal), that does not entitle you to any financial compensation.
6. Race Pack Delivery and Fulfillment (for Virtual Events)
For virtual events or any events where race packs (or finisher kits) are delivered to participants:
- Shipping of Race Packs/Kits: If the Organiser offers delivery of race packs, medals, or other items to participants, you must provide a valid and complete mailing address during registration or when requested. Shipping may be limited to certain regions as specified by the Organiser. Additional shipping fees may apply if not included in the registration fee (the event page will indicate if delivery is included or if you must pay extra).
- Delivery Timeframe: Dispatch of race packs or finisher kits usually occurs after you have completed the event (for example, after result submission and verification) or as scheduled by the Organiser. Delivery times can vary (especially for international deliveries). Please allow several weeks after the event period for your items to arrive, unless a different timeframe is communicated.
- Tracking: Where available, a tracking number or delivery confirmation may be provided to you via email or through the Platform once your package is shipped (this is "fulfilment tracking"). It is your responsibility to monitor the delivery status and make arrangements to receive the package.
- Delivery Issues: The Platform and Organiser will make reasonable efforts to ensure your items are delivered, but are not responsible for delivery issues outside their control. This includes delays or lost packages due to courier errors, incorrect addresses provided by you, or customs issues for international shipping. If an item is returned to sender due to an incorrect address or failure to collect, you may be responsible for additional re-delivery fees.
- No Guarantee of International Delivery: If you request shipment to a country outside of where the Organiser is based, be aware there may be customs duties, taxes, or import fees which you are responsible for paying. Additionally, certain items may not be able to be shipped internationally due to customs restrictions. The Organiser will inform you if they cannot fulfill delivery to your provided address, and may offer an alternative (such as an address change or pick-up option, or a refund of the portion of fee attributable to the undeliverable items if appropriate).
- Risk of Loss: Title and risk of loss for any physical goods (such as medals or apparel) pass to you upon handing over to the courier/postal service. This means if items are lost or damaged in transit, the Organiser will assist in filing claims with the courier, but is not obligated to send a new item at their expense. Any replacement or reshipment is at the Organiser's discretion.
7. Participant Conduct and Obligations
- Honesty and Integrity: You agree to participate fairly and honestly in any event you register for. You will not engage in any form of cheating, harassment of other participants, or behavior that is harmful to the integrity of the event. The Organiser has the right to impose penalties, disqualify, or ban participants for misconduct.
- Compliance with Laws: You will comply with all applicable laws and regulations while participating in an event. For physical events, this includes traffic rules, public safety laws, and any permit requirements. For virtual events, this includes only participating in locations and times where it is safe and legal for you to do so.
- Equipment and Environment: You are responsible for using appropriate equipment for the event (for example, proper running shoes, safety gear if required, etc.) and ensuring that your environment is safe (for instance, choosing a safe route for a virtual run). For any equipment lent to you by the Organiser (such as timing chips), you must return them as instructed or you may be charged a replacement fee.
- Respect for Instructions: Follow all instructions given by the Organiser, race officials, or posted on the event page. This includes pre-race briefings, route markings, checkpoint rules, and any community guidelines if using the Platform's social features.
- Personal Data and Privacy: You agree that we can share your registration information with the Organiser for the purposes of event administration. This will typically include personal data such as your name, contact information, age, gender (if relevant for categories), shirt size (if apparel is provided), and your submitted results. The Organiser may use this information to communicate with you about the event (e.g., to send instructions or race packs). Both we and the Organiser will handle your personal data in compliance with applicable data protection laws (such as Singapore's Personal Data Protection Act "PDPA") and our Privacy Policy. Please review our Privacy Policy for more details on how we handle your data.
- Consent to Communications: By registering, you consent to receive emails and notifications related to the event and your participation (such as confirmation messages, event updates, result confirmations, certificate availability, etc.). You may also receive promotional communications from us about other similar events or platform features, but you will have the opportunity to opt-out of marketing messages. However, you cannot opt out of essential event communications.
- Third-Party Services: If you use third-party services in connection with the event (for example, Strava for tracking, or social media to share your achievement), you understand that those services are independent of Heyrace. We are not responsible for third-party services or content. If you invite others or use a referral link, you must do so in a lawful and respectful manner (no spamming, etc.).
8. Limitation of Liability and Disclaimers
- Platform Role: Heyrace (Triple Wave Pte. Ltd.) acts primarily as an intermediary platform that facilitates the registration for events and the submission of results. We do not organize or sponsor the events (unless explicitly stated for a particular event). The Organiser of each event is a separate entity (which may be a company, group, or individual) responsible for the operation and quality of that event. We do not assume responsibility for the fulfillment of any event-specific obligations by the Organiser, including the holding of the event, the condition of the race course, delivery of race entitlements, or any safety measures. We simply provide the technology to connect participants and Organisers.
- No Warranty for Event Quality or Outcomes: We make no representations or warranties about any event listed on the Platform, including its safety, quality, accuracy, or fitness for a particular purpose. Any descriptions or content related to events are provided by the Organiser or based on information they provide. We do not guarantee that an event will meet your expectations or that it will be held on the advertised schedule (events may be cancelled or changed by Organisers). To the fullest extent permitted by law, the Platform and all services we provide are offered "as is" and "as available" without warranties of any kind.
- Liability for Personal Injury: You acknowledge that participation in races can be hazardous. To the maximum extent permitted by law, you agree that neither we (the Platform and our company, employees, and agents) nor the Organiser will be liable for any injury or death you may suffer as a result of your participation in an event, provided that nothing in these Terms seeks to exclude liability for death or personal injury caused by gross negligence or willful misconduct. You participate at your own risk and are solely responsible for any medical expenses or other losses you may incur.
- Liability for Property Damage or Loss: We and the Organiser are not responsible for any loss or damage to your personal property arising from participation in an event or use of the Platform. This includes loss or damage to equipment, personal items stolen or lost during a race, or data loss from using the Platform or third-party apps.
- No Liability for Indirect Damages: In no event will we be liable to you for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, lost opportunities, or other economic losses, even if we have been advised of the possibility of such damages. For example, we are not liable for any travel or accommodation costs you incur in connection with a race, even if the event is cancelled.
- Cap on Liability: To the extent that our liability is not otherwise excluded or disclaimed under these Terms, and to the extent permitted by law, our total aggregate liability to you for any claims arising out of or relating to your use of the Platform or participation in an event through the Platform is limited to the amount of the registration fees paid by you to us for that event. If no fee was paid or if the claim does not relate to a specific event, our total liability in all cases is capped at SGD $100.
- Indemnity: You agree to indemnify and hold harmless Triple Wave Pte. Ltd. (and its directors, officers, employees, and agents) from any and all claims, liabilities, damages, expenses, and losses (including legal fees on an indemnity basis) arising out of or in connection with (a) your breach of these Terms or any applicable laws or regulations, (b) your negligence or misconduct at an event or in using the Platform, or (c) any claim by a third party (including an Organiser or another participant) arising from your actions or omissions. This means that if someone (for example, another participant or a bystander) sues us for something that was your fault, you will cover our costs and damages.
- Third Party Claims and Release: Because the Platform is not the organiser of events (except where stated), if you have a dispute or claim regarding an event, you should address it with the Organiser. You agree not to bring any claim against us for matters that are the responsibility of the Organiser. In the event that you do have any right of action against the Organiser, that is between you and the Organiser. By agreeing to these Terms, you also release and discharge us from any and all liability or claims arising from the acts or omissions of Organisers or other third parties involved in the event.
- Force Majeure: We shall not be liable for any failure or delay in performing our obligations (including facilitating any event or registration) if such failure or delay is due to circumstances beyond our reasonable control, such as acts of God, war, civil unrest, strikes, natural disasters, pandemic-related restrictions, or interruptions in internet or communications infrastructure.
- Disclaimer of Warranties: To avoid doubt, we expressly disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that any defects will be corrected. We are not responsible for any technical malfunctions in equipment, network, or software that may affect operation of the Platform or any aspect of event registration or result submission.
9. Governing Law and Dispute Resolution
- Governing Law: These Terms and your use of the Platform are governed by the laws of the Republic of Singapore, without regard to its conflict of law principles.
- Jurisdiction: You agree that any dispute arising out of or relating to these Terms or your participation in events via the Platform shall be subject to the exclusive jurisdiction of the courts of Singapore. Notwithstanding this, we reserve the right to seek injunctive or equitable relief in any jurisdiction to enforce our intellectual property or protect our interests.
- Disputes with Organisers: As noted, any disputes or claims relating to the event itself (such as injury or dissatisfaction with event organization) are between you and the Organiser. The Platform may, at its discretion, assist in facilitating communication or resolution, but is not obligated to resolve disputes. If you have a complaint about an event, you should notify the Organiser in writing (with a copy to us, if it relates to the Platform's involvement) as soon as possible.
- Mediation: In the event of a dispute between you and us (Triple Wave Pte. Ltd.) that we cannot resolve amicably, we may suggest mediation through the Singapore Mediation Centre or a similar body before proceeding to court litigation, but this is not mandatory unless otherwise required by law.
10. Other Provisions
- Changes to Terms: We may update or modify these Participant Terms & Service from time to time. When we do, we will post the updated Terms on our Platform and update the "last updated" date. Material changes will be notified to you via email or via a prominent notice on the Platform. Continued use of the Platform or participation in events after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and may cancel any upcoming event registrations (though our standard refund policy will apply).
- Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remainder of the Terms shall remain in full force and effect. The invalid provision shall be interpreted, if possible, in a manner that most closely reflects the original intent of the parties.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of rights by us must be in writing to be effective.
- Entire Agreement: These Terms, along with the Privacy Policy and any event-specific terms you agree to, constitute the entire agreement between you and Triple Wave Pte. Ltd. regarding your use of the Platform to register for events. They supersede any prior agreements or communications on the same subject matter.
- Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our obligations or rights (in whole or in part) to an affiliate or in connection with a merger, acquisition, or sale of assets, with notice to you.
